These Terms of Service ("Terms") govern your access to and use of the websites, products and services provided by Jinova Digital Pty Ltd ("Jinova", "we", "us"), including the Field Service and Appointments & Booking workspaces. By creating an account or using our services, you agree to these Terms.
1. Your account
You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account and for the actions of team members you invite.
2. Subscriptions and billing
Paid plans are billed in advance on a recurring basis in Australian dollars, excluding GST unless stated. Prices are per workspace and cover the staff limits described on your plan.
3. Acceptable use
You agree to use our services lawfully and not to misuse the platform.
4. Your data
You retain ownership of the data you enter into your workspace. You grant us the limited rights needed to host, process and support the service. Our handling of personal information is described in our Privacy Policy.
5. Custom development and services
Where we provide custom development, websites, integrations or other professional services, the specific scope, deliverables, timeline and fees will be set out in a separate proposal or statement of work agreed with you. Those terms apply in addition to these Terms.
6. Availability
We work to keep the service available and reliable but do not guarantee uninterrupted access. We may perform maintenance, updates and improvements, and will aim to minimise disruption where possible.
7. Intellectual property
The Jinova platform, software, branding and content are owned by Jinova Digital Pty Ltd or our licensors. These Terms do not transfer any of our intellectual property rights to you beyond the right to use the service as intended.
8. Liability
To the extent permitted by law, our liability for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Termination
You may stop using the service and cancel at any time. We may suspend or terminate access if these Terms are breached. On termination, you can export your data for a reasonable period before it is removed in line with our data practices.
10. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you. Continued use of the service after changes take effect means you accept the updated Terms.
